Broken Relationship – Termination Negotiation and Support
What we deliver
- A Win-Win Exit Process. Facilitation and negotiation support that covers detailed technical knowledge, contractual expertise, excellent relationship management skills and a win-win exit process.
How you will benefit
- A collaborative outcome. This structured approach to negotiating an early exit and transition plan is ‘interest based’. In this way, you work together to agree the plan, and in turn, the supplier remains contractually accountable to provide fit for purpose support whilst you exit away from them, thus minimising any service disruption.
- The supplier’s advice is contracted for, separately. This negotiation process ensures the existing (incumbent) supplier remains contractually accountable for its advice, to provide suitable support to your new supplier.
Key contents of the Termination Negotiation and Support
Understanding of outcomes to be achieved
BPG facilitate so that supplier and client are clear about outcomes to be achieved, taking a ‘safe landing into the new supplier first’, ‘responsibility later’ approach.
Genuine collaborative working
We help to facilitate workshops across both your own team and the supplier (including legal) teams to assure the transition of services to the new supplier is smooth.
Collaboration aligned to contract terms
We assure the exit and transition approach works for yourselves, the outgoing supplier and the incoming supplier and does not undermine any of the contractual protections.
We facilitate negotiations between your legal and supplier legal teams using our deep domain technical, operational and contractual specialist support to minimise any adversity.
Roles and responsibilities
The supplier’s ‘Expert Responsibilities’ remain intact, whilst client teams support existing and new supplier exit and transition efforts to implement a ‘working first time’ approach.
